A. Nature of Defamatory Content

Posts on the Tea app often allege acts that besmirch a man’s name, safety, and honor. Some claim the man abused a partner, manipulated her, or left her in fear. Others say he gave her a disease. Still others call him a “cheater,” a “liar,” or say he posed as single while in a relationship. A few accuse him of crime outright: “arrested for domestic battery,” “on probation,” or “restraining order in place.” Each of these charges, if false, may give rise to a claim for defamation.

Defamation Per Se

The law splits such claims into two main groups: defamation per se and defamation per quod. A statement falls into the per se category if its words, read alone, would tend to disgrace the subject. Courts have long held that false charges of crime, disease, or moral fault fall in this group.

The Restatement (Second) of Torts § 570 defines per se defamation as that which “ascribes to another conduct, characteristics or a condition that would adversely affect his fitness for proper conduct of his lawful business or profession, or else tends to subject him to contempt or ridicule.” U.S. courts follow this rule with little change.

Courts across states have treated false charges of abuse or violence as defamation per se. A post that says “he hit me,” if false, imputes a crime and harms the man’s name in his work and life. The same holds for “he has herpes,” “he gave me an STD,” or “he didn’t tell me he had HIV.”

Courts treat such statements as squarely within the per se rule. Courts also place deceit in relationships within this zone, when it bears on moral worth or trust. So charges of cheating, lying, or manipulation may also fall under defamation per se, if framed as a trait or habit that suggests moral unfitness.

But not all such statements meet the bar. A post that says “he’s a narcissist” or “he played me” might fail to rise to defamation per se. These may fall instead under the law of defamation per quod.

Defamation Per Quod

Defamation per quod covers statements that need context to show the effect on the victim before a court will award damages. In such cases, a third-party exposed to the purported defamation must bring in facts outside the words themselves for the words to have any harm.

The classic case is where the charge, on its face, seems mild or vague, but turns out to be false and harmful once linked with outside facts. A post that says “he’s a red flag” or “he’s dangerous,” without more, might seem like opinion or slang. But if the platform trains users to link “red flags” with crime, harm, or deceit, the label may take on a fixed meaning that injures.

In that case, one might argue that the label, in context, implies facts that can be proved false.

Aggregated Harm

Tea app’s many posts could perhaps build an untrue picture by slow, steady pressure rather than with one singularly bold claim. When harm comes not from a single post but from many posts, likes, or tags, the law faces hard questions.

Does the weight of user ratings or “red flags” imply a known truth? If so, and the core claim is false, does the weight itself defame? These claims may soon rise to the front line of platform speech law.

The Role of Flags

The Tea app allows users to assign “red flag” or “green flag” markers to men discussed in posts.

  • Red flag = signals risk
  • Green flag = signals safety

Neither says why. The tags work as shorthand for blame or praise. They shape how readers see the man in question. Many flags, stacked together, form a public record—not of proof, but of social blame. The effect resembles a verdict, though no facts are tried.

Courts treat false statements that harm one’s name as defamation. A single red flag may not rise to that level. But a cluster of red flags, tied to a name and face, begins to speak louder. Repeated charges, even if brief, can create an image of guilt.

This raises the legal question: Can a set of symbols, viewed together, defame?

The answer turns on implication. In White v. Fraternal Order of Police, the court let a claim go forward where the speaker said only what was true, but in a way that led readers to think something worse. The test is how a fair reader would take the meaning.

One red flag may not imply much. But twenty red flags may together constitute a defamatory implication. Star-ratings on Yelp or Google raise a kindred issue. Courts have often treated them as opinion. Yet even courts that grant immunity under Section 230 have noted that a star rating, if backed by false facts or used to suggest a lie, might give rise to suit.

The more the rating points to a claim that can be proved false, the more it risks liability.

Identification of the Defamed Person

To sue for defamation, a man named on the Tea app must show that others could tell the post refers to him. The law does not require a full name, but rather enough clues point to one person.

A first name, a city, and a clear face may suffice. Courts look at how a reader, knowing the man, would read the post. If she can tell it is him, the law treats the post as “of and concerning” him.

This rule has long roots, and grants a defamed party the right to sue where someone slanders or libels the subject without naming him.

Courts take a broad view of what counts as identification. In Geisler v. Petrocelli, the court found that a character in a novel could defame a real woman if readers would link the two.

The same rule applies here. A photo and first name, tied to a small town or tight-knit group, can make the man known.

A post that says “Jason, 31, from Tampa” with a clear image may not need a last name; even blurred images or initials may suffice where context fills in the rest.

Harm and Injury

Once the post points to one man, the next step is to determine whether the post caused harm. A false post that says he lied, cheated, hit a woman, or has some sort of social disease may cause others reading the post to judge him less fit to date, work, or live in peace.

That reputational harm can be compensated as a legal injury. The harm need not take the form of lost money. Shame, fear, and loss of trust all count as real harms, harms the law treats as injury-in-fact, enough to bring suit.

Potential Claims

The man may then bring claims under more than one tort:

  • Libel → a written falsehood that harms his name
  • False light → when facts are partly true but framed to cast someone in a cruel light
  • Intentional infliction of emotional distress → requires showing that the post was not just false, but cruel and recklessly indifferent

The App’s Role

The Tea app does more than host speech. It curates, prompts, and frames it. Its design guides what users say and how others read it.

It asks not just for stories, but for signs: Was he a red flag? A green flag? Did he ghost you? Did he lie?

Tea does not name men or write posts, but it may set the tone and terms, if its prompts steer users toward concentrating on bad reviews of men.

A prompt that says “What red flags did you notice?” could be said to encourage libel by its very framing. If thousands of users, all led through the same path, post in the same way, a plaintiff may be able to argue that the design of the app itself helped shape the defamation.


B. Section 230

Section 230(c)(1) of the Communications Decency Act bars courts from treating a provider or user of an “interactive computer service” as the speaker or publisher of information “provided by another information content provider.”

The statute shields online platforms from most claims based on content that users, not the platform, create. The text sets a broad floor: a platform shall not “be treated as the publisher or speaker of any information provided by another.”

Courts have read this to bar most tort claims that treat a site as liable for what a user wrote. The aim, from the start, was to foster free exchange on the internet without subjecting hosts to ruinous liability for what others post.

Limits of Section 230

But the shield holds only so long as the platform acts as a host, not a speaker. The statute protects those platforms that let users speak, rather than those that in some way or another help shape the message.

Section 230 draws a line between a site that provides tools and one that creates or helps create content. If the site adds, changes, or prompts the words in a way that shapes their meaning, it may become a “developer,” or a co-developer, of the content.

In that case, it does not just host the speech—it helps to make it. A company in that position could lose the protection of Section 230 immunity.

If courts see Tea’s tools and design as doing more than host, but rather as urging, shaping, or amplifying speech, they may treat Tea as a co-developer.

If Tea uses AI tools such as to detect catfish profiles or make background checks, or if it uses code to tag, rate, or flag a person, then a plaintiff may claim that the app is speaking in its own voice, not the user’s.

While no court has yet ruled on this exact issue, a platform that “materially contributes” to the unlawful content may lose its shield.


C. Opinion vs. Fact Doctrine

The First Amendment does not shield all that one calls “opinion.” In Milkovich v. Lorain Journal Co., the Supreme Court made clear that no talismanic phrase (“in my opinion,” “I believe,” or the like) can turn a provable falsehood into protected speech.

If a speaker implies a fact that a jury can test for truth, and the fact proves false, the law treats it as defamation.

The Test

The core test, drawn from Milkovich, asks whether the statement implies an assertion of fact.

  • Nonactionable opinion: “I don’t like him,” or “he’s a jerk.”
  • Defamation (if false): “He abused me,” or “he broke the law.”

Courts do not read words in a void. They weigh tone, setting, and how a reader would take them.

In some cases, a hyperbolic tone (“he’s Satan”) makes clear the speaker does not mean what he says. But if the charge, read in context, seems serious and meant to be true, courts treat it as fact.

That rule holds even if the statement appears on a forum known for loose talk.

Examples from Tea

The Tea app includes both types of speech:

  • Likely opinion: “He gave me the creeps,” “Bad vibes,” “Trust your gut.”
  • Likely fact: “He has a domestic violence record,” “He’s on probation,” “He assaulted me.”

The line between the two is not always clear. For example:

  • “He’s a predator” → may be metaphor or moral claim
  • “He targets younger women and lies about his age” → may inch toward a claim of fact

Role of Anonymity

Anonymity complicates matters.

  • On one hand, anonymous speech may lack weight.
  • On the other hand, courts do not require the speaker to be known for liability to attach.

A false charge does harm whether signed or not.

Anonymity also weakens the speaker’s ability to show personal knowledge. If sued, the anonymous poster may find it hard to prove her words true.


IV. Broader Liability

A platform that builds a tool to spread speech owes no duty to moderate its content—at least not under common law. But that rule may shift where the design itself gives rise to harm.

A court may find fault not in what the platform failed to take down, but in what it chose to build.

If the platform receives notice of falsehood and does nothing, the law may take note. Tea’s design makes it easy for users to accuse men, yet hard for any man who may be falsely accused to clear his name.

That choice, in the eyes of the law, may carry a price. Whether courts will impose that cost turns not on the First Amendment, but on the older rules of tort.
